Terms of Use – PlantMate (by UNIQXEL)

These Terms of Use (“Terms”) govern your use of PlantMate: AI Plant Identifier (“PlantMate”, “the App”), operated by UNIQXEL (“we”, “us”, “our”).

By downloading, accessing, or using PlantMate, you agree to these Terms.


If you do not agree, please do not use the App.

 

 

 

1. Eligibility

 


You must:

 

  • Be at least 13 years old (or the minimum legal age in your country).

  • Have the legal capacity to enter into this agreement.

 


If you are using PlantMate on behalf of an organization, you confirm you are authorized to do so.

 

 

 

2. Description of the Service

 


PlantMate provides:

 

  • AI-powered plant identification from photos

  • Basic health assessment based on visual indicators

  • Simple care suggestions for plants

 


We may add, modify, or remove features from time to time.

 

 

 

3. 5 Free Monthly Scans & Purchases

 


Free Scans

 

  • Each user may receive 5 free scans per month (or as displayed in the App).

  • Free scans reset monthly and are non-transferable and non-refundable.

 


Paid Scans & Subscriptions

 

  • You may purchase extra scans or subscriptions through the App Store / Google Play.

  • Prices, billing periods, and features are shown in the App at purchase.

  • Payments are processed by Apple/Google or authorized providers; their terms apply.

 


Auto-Renewal

 

  • Subscriptions (if offered) may auto-renew until canceled.

  • Manage or cancel via:

     

    • App Store > Subscriptions, or

    • Google Play > Payments & subscriptions.

     

 


Refunds

 

  • Refunds are generally handled by the store (Apple/Google) according to their policies.

  • We are not obligated to provide refunds beyond what is required by law.

 

 

 

 

4. License & Acceptable Use

 


We grant you a limited, non-exclusive, non-transferable, revocable license to:

 

  • Download and use PlantMate for personal, non-commercial purposes.

 


You agree not to:

 

  • Reverse engineer, decompile, or attempt to access source code

  • Bypass or interfere with security or technical protections

  • Use the App for unlawful, harmful, or abusive purposes

  • Upload content that is illegal, infringing, or harmful

  • Use automated systems to excessively access or abuse the service

 


We may suspend or terminate accounts that violate these Terms.

 

 

 

5. User Content

 


“User Content” includes photos, text, and other materials you submit.


By submitting content, you:

 

  • Represent that you own or have the rights to use it

  • Grant UNIQXEL a non-exclusive, worldwide license to use, process, store, and analyze it:

     

    • To provide the App’s features

    • To improve the service and models (where permitted and/or anonymized)

    • In accordance with the Privacy Policy

     

 


You remain responsible for your content.

 

 

 

6. No Professional Advice

 


PlantMate’s outputs (identification, health status, care tips):

 

  • Are generated by AI based on visual and contextual signals

  • Are estimates only and may be incomplete or inaccurate

  • Do not constitute professional botanical, agricultural, landscaping, or pest-control advice

 


You should not rely solely on PlantMate for critical decisions (e.g., crop protection, toxic plants, medical emergencies for humans or animals). Always verify with qualified professionals where needed.

 

 

 

7. Availability & Modifications

 


We aim to keep the App available and functioning, but:

 

  • We do not guarantee uninterrupted or error-free operation.

  • We may modify, suspend, or discontinue parts or all of the App at any time, with or without notice.

 

 

 

 

8. Intellectual Property

 

 

  • PlantMate, including its name, design, code, models, and content (excluding your User Content), is owned by UNIQXEL or its licensors.

  • You may not use our trademarks, branding, or materials without prior written consent.

 

 

 

 

9. Limitation of Liability

 


To the maximum extent permitted by law:

 

  • UNIQXEL and its affiliates shall not be liable for:

     

    • Indirect, incidental, consequential, or punitive damages

    • Loss of data, revenue, profits, or goodwill

    • Reliance on App results or decisions made based on them

     

  • Our total liability for any claim related to your use of the App will not exceed the amount you paid for the App or services in the last 3 months (if any).

 


Some jurisdictions do not allow certain limitations; in that case, applicable protections will still apply to you.

 

 

 

10. Indemnification

 


You agree to indemnify and hold harmless UNIQXEL from claims arising out of:

 

  • Your misuse of the App

  • Your violation of these Terms

  • Your violation of any law or third-party rights

 

 

 

 

11. Governing Law

 


These Terms are governed by the laws of [Insert Country/Region], without regard to conflict of law principles.
